Terms of service

By accessing or using newfineseplease.ca (“the Site”) or placing an order with Newfinese Please (“we”, “us”, “our”), you agree to be bound by these Terms of Service and all policies referenced herein, including our Privacy Policy, Shipping Policy, and Refund Policy. If you do not agree, please do not use the Site.

We reserve the right to update these Terms at any time. Updated Terms are effective immediately upon posting. Continued use of the Site after any update constitutes acceptance.

 

You must be at least 18 years of age, or the age of majority in your province or territory, to place an order on this Site. By using the Site, you represent that you meet this requirement.

Our Site is currently available to Canadian residents only. By placing an order, you confirm that your shipping address is located within Canada.

 

All products sold on this Site are made to order. Your order goes into production specifically for you after purchase. Because of this:

 

•     Product images are as accurate as possible, but colours may appear slightly different on different screens due to monitor calibration

•     Minor variations between the product image and the finished item are not considered defects

•     We reserve the right to discontinue any product at any time

•     In the rare event a product cannot be produced as ordered, we will contact you and offer a full refund

 

All prices are listed in Canadian dollars (CAD). Prices are subject to change without notice. Applicable taxes are calculated at checkout based on your province.

We accept payment through Shopify Payments, which processes major credit and debit cards securely. By placing an order, you represent that you are authorized to use the payment method provided.

We reserve the right to cancel any order where a pricing error has occurred. In such cases, we will notify you and issue a full refund.

 

When you place an order, you receive an order confirmation by email. This confirmation acknowledges receipt of your order — it does not constitute acceptance of the order or a guarantee of fulfilment.

Because our products are made to order, we begin production promptly. Cancellations may be possible if requested immediately after placing an order. Email support@newfineseplease.ca as quickly as possible with your order number. We cannot guarantee cancellation once production has begun.

Because all items are made to order, we do not accept returns for change of mind or sizing errors. We encourage customers to consult the size guide before ordering and to contact us with any questions before purchase.

 

All content on this Site — including but not limited to product designs, graphics, text, logos, the Newfinese Please puffin mark, photographs, and the selection and arrangement of content — is owned by or licensed to Newfinese Please and is protected under Canadian and international copyright law.

You may not reproduce, distribute, modify, display, transmit, or create derivative works from any content on this Site without our express written permission. This includes copying designs for personal or commercial use.

Purchasing a product grants you ownership of the physical item only. It does not transfer any intellectual property rights in the design printed on that item.

 

You agree not to use the Site to:

 

•     Violate any applicable law or regulation

•     Submit false or misleading information in an order

•     Use any automated means to scrape, crawl, or extract data from the Site

•     Interfere with or disrupt the operation of the Site or its servers

•     Impersonate any person or entity

•     Attempt to gain unauthorized access to any part of the Site

 

Our Site may contain links to third-party websites, including our partners and social media platforms. These links are provided for convenience only. We have no control over the content or privacy practices of those sites and accept no responsibility for them. Visiting a linked site is at your own risk.

 

The Site and its content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

 

To the fullest extent permitted by applicable law, Newfinese Please, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of our products, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from your use of the Site or a purchase shall not exceed the amount you paid for the specific order giving rise to the claim.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable Canadian law.

 

You agree to indemnify and hold harmless Newfinese Please and its owners, officers, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your violation of these Terms or your use of the Site.

 

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the collection and use of your information as described in our Privacy Policy.

 

These Terms are governed by and construed in accordance with the laws of the Province of Newfoundland and Labrador and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Site shall first be addressed by contacting us at support@newfineseplease.ca. We will make a genuine effort to resolve disputes informally. If a dispute cannot be resolved informally, it shall be submitted to the courts of competent jurisdiction in Newfoundland and Labrador.

 

These Terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, constitute the entire agreement between you and Newfinese Please with respect to the Site and supersede all prior agreements and understandings.

 

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
