Terms of service

By accessing or using newfineseplease.ca ("the Site") or placing an order with Newfinese Please ("we", "us", "our"), you agree to be bound by these Terms of Service and all policies referenced herein, including our Privacy Policy, Shipping Policy, and Refund Policy. If you don't agree, please don't use the Site.

We reserve the right to update these Terms at any time. Updated Terms are effective immediately upon posting. Continued use of the Site after any update means you accept the changes.

You must be at least 18 years of age, or the age of majority in your province or territory, to place an order. By using the Site, you're confirming you meet this requirement.

Our Site is currently available to Canadian residents only. By placing an order, you confirm that your shipping address is within Canada.

Everything we sell is made to order — your item goes into production specifically for you after you purchase. Because of this:

• Product images are as accurate as we can make them, but colours may look slightly different on different screens due to monitor calibration
• Minor variations between the product image and the finished item are not considered defects
• We reserve the right to discontinue any product at any time
• In the rare event a product can't be produced as ordered, we'll contact you and offer a full refund

All prices are in Canadian dollars (CAD) and may change without notice. Applicable taxes are calculated at checkout based on your province.

We process payments through Shopify Payments, which handles major credit and debit cards securely. By placing an order, you confirm you're authorized to use the payment method provided.

If a pricing error occurs, we reserve the right to cancel the order. We'll let you know and issue a full refund.

When you place an order, you'll get a confirmation email. That confirmation acknowledges we received your order — it's not a guarantee of fulfilment.

Because items are made to order, production starts quickly. If you need to cancel, email support@newfineseplease.ca immediately with your order number. We'll do our best, but we can't guarantee cancellation once production has begun.

Because all items are made to order, we don't accept returns for change of mind or sizing errors. Please use the size guide before ordering and reach out before you buy if you have any questions — we're happy to help.

Everything on this Site — product designs, graphics, text, logos, the Newfinese Please puffin mark, photos, and the way it's all put together — belongs to us or is licensed to us, and is protected under Canadian and international copyright law.

You can't reproduce, distribute, modify, display, or create derivative works from anything on this Site without our written permission. That includes copying designs for personal or commercial use.

Buying a product gives you ownership of the physical item. It doesn't transfer any rights to the design on it.

You agree not to use the Site to:

• Violate any applicable law or regulation

• Submit false or misleading information in an order

• Use automated tools to scrape, crawl, or extract data from the Site

• Interfere with or disrupt the Site or its servers

• Impersonate any person or entity

• Attempt to gain unauthorized access to any part of the Site

Our Site may link to third-party websites — partners, social platforms, and so on. Those links are there for convenience. We don't control those sites and we're not responsible for their content or privacy practices. Visit them at your own discretion..

The Site and its content are provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
We don't guarantee the Site will always be available, error-free, or free of anything unpleasant.

To the fullest extent permitted by Canadian law, Newfinese Please and its owners, employees, and agents won't be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products.

Our total liability for any claim won't exceed the amount you paid for the specific order that gave rise to it.

Nothing here limits liability for death, personal injury caused by negligence, fraud, or anything else that can't be excluded under Canadian law.

You agree to indemnify and hold harmless Newfinese Please and its owners, officers, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your violation of these Terms or your use of the Site

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the collection and use of your information as described there.

These Terms are governed by the laws of the Province of Newfoundland and Labrador and the federal laws of Canada, without regard to conflict of law principles.

If something goes wrong, please email us first at support@newfineseplease.ca — we'll make a genuine effort to sort it out. If we can't resolve it informally, any dispute will be submitted to the courts of competent jurisdiction in Newfoundland and Labrador.

These Terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, make up the entire agreement between you and Newfinese Please. They supersede any prior agreements or understandings.

If any part of these Terms is found to be unlawful or unenforceable, that part will be removed and the rest will remain fully in effect.
